This is the Privacy Policy of the Rise-X Digital Services Pty Ltd (ABN 45 640 133 615) and its related corporate entities (such as subsidiaries and affiliates) (we, us and our).This Privacy Policy explains how we collect, store, use and share your personal information when you use our products or services (together our Services), or otherwise interact with us (for example by communicating with us or attending our premises or events).If you do not agree with this Privacy Policy, then you must not access or use our Services or interact with our business.  You must ensure that any organisation or individuals who you permit, or enable through your act or omission, to access or use the Services or whose information is disclosed to Rise-X, are aware that Rise-X may use and disclose information about them in accordance with this Privacy Policy.  Examples of where the forgoing applies to you include: where you are our customer acquiring Services under an agreement with us, then you must comply with this Privacy Policy and ensure any person or organisation you permit or invite to use the Services is made aware of it; or where you are invited to access or use the Services by our customer, then you must comply with this Privacy Policy and ensure anyone who uses the Services is made aware of it; you access or use our website.Where we provide Services to an organisation (for example, your employer or an organisation that has invited you, or you are invited via your employer, to participate on a Service provided to our customer), that organisation controls the information provided to and processed using the Services. This policy does not apply to the extent we process personal information in the role of a processor on behalf of such organisations.This Privacy Policy took effect on the date set out above. We may need to update it from time to time.  When we do so, the updated version will be posted on this website.

Payment Information: we collect payment and billing information for the Services, including billing representative and their name and contact information and payment information.

We encourage our users to be aware, when they leave our website, to read the privacy statements of each and every website that collects personal identifiable information.

Information we receive from other sources: we may receive information about you from other users of our Service our related companies, social media platforms, public databases, our business and partners. We may combine this information with information we collect.

Information you provide about others: you may need to provide personal information about other individuals to us, for example your authorised representatives or users of the Services. Where you provide personal information about others, you must obtain their consent, let them know you are giving us their personal information and tell them about this Privacy Policy.

3. How we use information we collect

We use the information we collect in a variety of ways.

Providing the Services: we use information about you to provide the Services to you, including to process transactions with you, authenticate you when you log in, provide customer support, and operate, maintain, and improve the Services.

5. Who do we share your personal information with?

Our Service Providers: we use and work with third-party service providers to provide our Services, including software development, customisation of our Services for you, hosting of our Services and platforms, maintenance, backup, storage, payment processing, analysis, marketing, and other services we acquire to operate our business and provide the Services to you. In doing so, our third-party service providers may be required to access or use information about you.

The above does not apply where you provide the information yourself directly to the service provider and that information is collected or stored by that third party, for example on a third party’s payment platform that you are directed to from our website or Services to process payments.  In that case the supply of information is between you and the third party as the information is not collected, stored or controlled by us.

When you invite someone onto your Service: the Services enable you to invite others to your Service, for example to participate in the workflows you create using the Services.  When you do so, information about you, such as your name and contact details, are shared with those you invite to use the Services.

Where required by law and to protect legitimate business interests and legal rights: where required by law or where we believe it is necessary to protect legal rights and interests of ourselves, you or others, we may share information about you in connection with compliance with laws and law enforcement, legal claims, compliance, regulatory, and audit functions.  For example, where we believe that sharing your information is reasonably necessary to comply with applicable laws, regulations, legal processes or governmental request, such as meeting national security requirements, for the enforcement of our agreements with you and our Policies, protecting the security or integrity of our Services and the platforms over which they are provided, protect our other users, the public and ourselves from illegal activities or harm or responding to emergencies where we reasonably believe we are required to disclose information to assist in preventing death or personal injury to any person.

Where you consent: we may share your information where you provide your consent to us to do so.

We may share your information outside Australia: we may need to share your personal information with organisations or our other group entities that are located outside of Australia, for example in the following countries and regions: Philippines, Singapore, Europe, United Kingdom and the United States of America.

Whenever we do this, we require these parties to take appropriate measures to protect your information and restrict how they can use it.

6. How long we keep your information

Following termination or deactivation of your user account, Rise-X will retain your profile information and User Content for a commercially reasonable time, and for as long as we have a valid purpose to do so. In particular, Rise-X will retain your information for the purpose of complying with its legal and audit obligations, and for backup and archival purposes.

Our Services are intended for use by organisations. In such cases, that organisation is the administrator of the Services and is responsible for the information it collects or over which it has control. Where that is the, any data privacy questions you may have need to be directed to the relevant administrator, as your use of the Services may be subject to that organisation's policies. We are not responsible for the privacy or security practices of such organisations, which may be different to our policy.

We may update this policy from time to time to reflect our current practice and ensure compliance with applicable laws. When we post changes to this policy, we will revise the “Last Updated” date at the top of this policy.
